Tier II Chemical Reporting

The Tier II chemical reporting program is designed so that facilities that use, store or manufacture hazardous materials comply with Title III of the Superfund Amendments & Reauthorization Act (SARA Title III) that states that communities have the right to know what hazardous materials are located in their area.

Pennsylvania Facilities covered by the Federal OSHA Hazard Communications Standard must file a Tier II report for:

Extremely Hazardous Substances at or above the Threshold Planning Quantities, or 500 lbs. (whichever is less) at any time during the calendar year.

Hazardous Substances at or above 10,000 lbs. at any time during the calendar year.

Facilities must file a report by March 1, with their county LEPC, Pennsafe and their local fire department for chemicals meeting the above criteria that were used, stored or manufactured at their facility anytime during the previous year. Fee's must also be paid to the LEPC and Pennsafe. The Columbia County LEPC charges $75.00 per chemical plus $100.00 planning fee if one or more of the chemicals are listed as extremely hazardous.

Facilities exempt from filing Tier II reports are those whose inventories never exceeded the threshold requirements at any time the previous year, government facilities, public schools, universities or private sector mining.

Family farms and service stations, including auto body repair shops must file Tier II reports if their inventories meet or exceed the prerequisite but are not required to pay any fees.

The following items are exempt from Tier II reporting:

  • Products regulated by the FDA

  • Household packaged products

  • Substances used in hospital, lab or other medical research

  • Substances used in routine agricultural operations

  • Fertilizers held for sale by retailers
